GENERAL TERMS AND CONDITIONS OF BOOKING / SALE

GENERAL INFORMATION

Evancy must be in possession of all personal data, including the address, telephone number and e-mail address of all persons present during the stay, in order to be able to carry out essential communication with you. Otherwise, Evancy is unable to provide you with important arrival and departure information (safe key, code, itinerary description, etc.). 

Evancy residences are not suitable for group or individual stays away from home by minors under the age of 18, unaccompanied by their legal guardians. Evancy reserves the right to refuse access to the flat, room or villa, which may have been booked in disregard of this provision to minors under 18 years of age who are not accompanied by their legal guardians and who present themselves at the reception of the Residence, and to cancel the stay immediately. 

It is also prohibited to allow guests or pets to stay who were not declared at the time of booking. Should an Evancy employee or representative discover such an occurrence, Evancy reserves the right to withhold part or all of the security deposit, or to evict the occupant from the accommodation without entitlement to a refund.

If you are entitled to a discount, please state this at the time of booking. Discounts cannot be applied retrospectively. Discounts cannot be combined, unless specifically stated otherwise.

The full amount of your booking must be paid 7 days before your arrival. Any payment not made on time will result in the cancellation of your booking.

You may also book several properties under the same booking. If you have a preference for a particular property, please let us know at the time of booking, but unfortunately we cannot guarantee that this property will be allocated to you.

Request for mediation by the CMAP

A consumer may submit a request for mediation to the CMAP, subject to the conditions set out below in Article 3. The consumer must refer the matter to the CMAP either:

- via the form available on the CMAP website at www.cmap.fr/consommateurs

- or by post to CMAP – Service Médiation de la consommation, 39 avenue Franklin D. Roosevelt, 75008 Paris.

PRICES

The prices shown in the brochure and on https://www.evancy.fr may differ from the price actually applied at the time of booking. Evancy reserves the right to change prices and/or to charge a supplement. Evancy also reserves the right to change discounts and discount regulations. The price stated on the confirmation/invoice is binding.

The price includes :
- Rental
- VAT
- Supply of bed linen
- Final cleaning
- Bath towels

The price does not include
- Other supplements (baby kit, pet, service kit, etc.)
- Cleaning during your stay (on request)
- Breakfast
- Late check-out
- Extra bed linen
- Extra towels

If you book online, you will receive a detailed overview of all charges and a total price during the booking process.
Evancy reserves the right, up to 72 hours after booking, to adjust the price or cancel the booking in the event of an obvious error in the price on the website, in particular in the event of a sale at a loss in accordance with Article L 420-5 of the French Commercial Code. 

Discounts

Certain discounts apply to the price subject to specific conditions.

They : 

• cannot be combined with other offers or promotions

• do not apply to bookings that have already been made

• apply to specific arrival dates, periods or target groups (e.g. senior citizens, families with young children, etc.)

• apply to a limited number of suites and/or room types

• are subject to change at any time

• are never applicable retroactively

Once your booking has been confirmed or an invoice issued, you can no longer claim any discounts.

CHANGES & CANCELLATIONS

Changes

If you wish to change the dates of your stay after booking, you may do so up to 8 days before your arrival. Subject to availability, it is possible to make additional bookings or extend your stay. Please always notify us of any changes or cancellations by telephone on the following number: +33 (0)3 20 15 36 00.

Cancellations

• If you cancel up to 8 days before your arrival date, no charge will be made.

• In the event of cancellation, changes or a no-show within 8 days of the arrival date, the full amount of the booking will be charged.

• For any cancellation made more than 8 days before the arrival date, the full rental amount is due.

Reception

You can contact reception on +33 (0)3 20 15 36 00 on weekdays from 9.00 am to 5.30 pm and on Saturdays from 10.00 am to 6.00 pm.

• Check-in

Check-in is from 3.00 pm. If you have not arrived within 24 hours of the agreed date without giving notice, this will be considered a cancellation (with no refund).

• Check-out

On the day of departure, please vacate your accommodation by 11.00 am. We reserve the right to carry out cleaning work from 8.00 am in the vicinity of your accommodation. All guests must comply with the residence’s general rules and regulations. Any breach of these rules may result in expulsion from the residence without entitlement to a refund. MISCELLANEOUS

General

All rates are exclusive of local taxes (visitor’s tax). Taxes are payable by all non-exempt persons. Each holiday home has a unique layout. We expressly reserve the right to alter the layout of our estate and the items located therein, as well as the operation of the estate. All prices quoted are in euros and include VAT. These terms and conditions supersede all previous terms and conditions and take precedence over any other publication or notice.

Force majeure

If the performance of the contract is wholly or partially impossible, temporarily or otherwise, due to circumstances beyond Evancy’s control (strikes, risk of war, sieges, fire, floods, storms and other incidents of any kind), this shall constitute force majeure.

Liability

We accept no liability for:

• Theft, loss or damage of any kind, either during or following a stay in the park or in a holiday home.

• Any technical equipment being out of order or out of service, or any tourist facilities in the park or holiday home being removed or closed.

• Information provided verbally or by telephone.

• Nuisance, such as disturbance, caused by third parties for whom we are not responsible.

• Printing errors in our correspondence and/or communications.

The tenant (M/F) and those accompanying them are jointly and severally liable for any loss or damage that may cause harm to Evancy or any third party as a direct or indirect consequence of their stay, regardless of how or by whom such loss or damage is caused.

Evancy reserves the right to make changes to its range of holiday rental packages. Even under exceptional circumstances, Evancy reserves the right to close the suites. In such cases, we will ensure the booking is rescheduled, offering a new date or a cancellation free of charge. There is no entitlement to any other form of compensation. Please note that maintenance work may always be carried out, without you being entitled to compensation or indemnity. For parks currently under construction or undergoing renovation, Evancy reserves the right to rebook your reservation to another destination of at least equivalent quality.

Complaints

If you have a complaint, please contact Evancy’s central telephone number +33 (0)3 20 15 36 00 within two hours of your arrival so that Evancy can do everything possible to resolve the issues. If the issues have not been resolved to your satisfaction, please submit a complaint by email to info@evancy.com within one month of your departure. Any compensation awarded may never exceed the net rental amount (excluding supplements and surcharges).

Pets

A maximum of two pets are permitted per booking. Pets must be vaccinated in accordance with legal requirements, and proof of this must be provided to Evancy prior to arrival. The owner and/or accompanying person is responsible for their pet. Pets must be kept on a lead in the grounds. The accompanying person must collect and dispose of the pet’s waste. The supplement of €12 per night per pet that you pay covers the cost of disinfecting the apartment. All pets must be declared at the time of booking. If you fail to declare a pet, the daily supplement per pet will be doubled and deducted from the deposit, plus an administration fee.

Cleaning

Final cleaning is always included in the price of your stay. For longer stays, an interim clean is mandatory. The apartment must be cleaned every 14 days. The interim clean is charged according to the type of accommodation. Fresh bed linen can also be provided for longer stays. You pay €5 per additional set of bed linen.

General

All data provided to us, including via our website, is used to respond to your enquiries and is stored in our database. This database is used for customer administration, sales, marketing and accounting purposes. This data may be used to provide targeted information and offers regarding our products and services, either by us or by third parties. We will update and supplement your data where necessary and delete it at your first request. Evancy has taken the utmost care in compiling this brochure, information, communication and website, but it is impossible to guarantee its accuracy and/or completeness at all times. Evancy excludes all liability of any kind arising from inaccuracies and/or omissions. Evancy's general terms and conditions apply to all bookings and offers.
